Weinig zzp’ers werken met modelovereenkomst
87% van de zzp’ers werkt niet of nauwelijks met modelovereenkomsten. Dat blijkt uit onderzoek door TNS NIPO in opdracht van de ABU (Algemene Bond Uitzendondernemingen) en Bovib (Brancheorganisatie voor intermediairs en brokers). De modelovereenkomst is in plaats van de VAR-regeling gekomen (Verklaring arbeidsrelatie) en moet schijnzelfstandigheid tegengaan.
Alleen intermediairs enthousiast
Zzp’ers geven aan dat een modelovereenkomst niet nodig is en dat een opdrachtgever er niet naar vraagt. Dat laatste sluit aan bij de antwoorden van opdrachtgevers: zo’n 90% geeft aan hier (bijna) nooit mee te werken. Alleen onder intermediairs is de modelovereenkomst gangbaar: slechts 37% geeft aan de overeenkomst niet te gebruiken. TNS NIPO ondervroeg in opdracht van de brancheverenigingen een kleine 1300 zzp’ers, opdrachtgevers en intermediairs.
Te vroeg
De Belastingdienst beaamt dat een modelovereenkomst lang niet altijd nodig is, omdat vaak wel duidelijk is dat een ondernemer of zzp’er niet in loondienst is. Overigens waarschuwen ABU en Bovib dat het nog te vroeg is om verregaande conclusies te trekken op basis van dit onderzoek. Begin 2017 zullen de partijen opnieuw onderzoek laten verrichten. Verwacht wordt dat de gevolgen van de Wet DBA dan duidelijker vorm hebben gekregen.
